Terms of Service

Last updated 24 September 2026

These Terms of Service (the “Terms”) govern your access to and use of taggedgu.com and any related sites, applications, features, data and services we make available (together, the “Service”). The Service is operated by Tagged GU LLC, an Indiana limited liability company (“Tagged GU,” “we,” “us” or “our”).

By accessing the Service, creating an account, or indicating acceptance of these Terms, you agree to be bound by them. If you do not agree, do not access or use the Service.

1. The Service

Tagged GU provides an informational reference service relating to sports memorabilia and related collectibles. The Service may include, without limitation, compiled records of publicly reported auction results and listings, descriptive and classification information, search and filtering tools, comparative and analytical features, alerts, and such other features as we may offer from time to time.

We are not an auction house, dealer, broker, appraiser, grader or authenticator. We do not offer items for sale, solicit or accept bids, take custody of property, or participate in any transaction between you and any third party. Unless expressly stated, we are not affiliated with, endorsed by or acting for any auction house, authenticator, league, team or other organisation referenced on the Service.

We may add, modify, suspend, limit or discontinue any part of the Service, including any feature, data set, source or method of access, at any time and without notice or liability.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. By using the Service you represent and warrant that you meet these requirements and that your use complies with all laws applicable to you.

Access to some or all of the Service may require an account, and may be limited, invitation-only or otherwise restricted at our discretion. You agree to provide accurate information, to keep your credentials confidential, and to remain responsible for all activity under your account. You must notify us promptly of any unauthorised use.

Accounts are personal to you and may not be shared, transferred or made available to others.

3. Permitted use and restrictions

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to access and use the Service for your own lawful reference and research purposes. All other uses are reserved.

Your use of the Service is further subject to the Data and Commercial Use Policy, which is incorporated into these Terms by reference. Except as that policy expressly permits, or as we may agree in writing, you shall not, and shall not permit or assist any person or system to:

4. Protection of the Service

We may, at our discretion and without notice, employ such measures as we consider appropriate to protect the Service, its content and its sources, including monitoring for prohibited activity, rate limiting, verification measures, restricting or blocking accounts, addresses or devices, and withdrawing access. We reserve all rights and remedies available to us at law and in equity.

5. Intellectual property and third-party content

The Service, including its compilation, organisation, classification, presentation, software and design, and all intellectual property rights in the foregoing, is and remains our property or that of our licensors. These Terms grant no rights other than as expressly stated.

The Service references and may reproduce, in whole or in part, listing titles, descriptions, images and other material published by auction houses and other third parties. Such material remains the property of its respective owners and is referenced for identification, reference and informational purposes. Third-party names and marks are the property of their respective owners.

6. Notices and removal

If you are a rights holder and consider that material on the Service should be removed, contact policy@taggedgu.com with sufficient detail to identify the material. It is our practice to act on such requests promptly. We may remove, restrict or decline to display any content at any time, for any reason, without obligation to any person.

7. Submissions and feedback

If you submit corrections, suggestions, feedback or other material to us, you grant us a perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable licence to use, reproduce, modify and otherwise exploit it for any purpose, without attribution or compensation. You represent that you are entitled to make the submission. We owe no duty of confidentiality in respect of any submission.

8. Charges, advertising and commercial arrangements

The Service is currently made available without charge. We reserve the right at any time to introduce fees, subscriptions, paid tiers, advertising, sponsored or promoted placement, affiliate or referral arrangements, or other commercial arrangements, and to vary or withdraw them. Where any such arrangement requires disclosure under applicable law, we will make that disclosure.

9. Information, accuracy and no advice

Information on the Service is derived from third-party sources and from our own processing of those sources. It may be incomplete, inaccurate, out of date, mis-classified or otherwise unreliable. We do not verify, authenticate, appraise or endorse any item, listing, description, authentication, attribution, claim of use, or reported price.

Nothing on the Service constitutes financial, investment, legal, tax, appraisal or other professional advice, or any recommendation to buy, sell, bid on, insure or value anything. Any decision you make in reliance on the Service is made at your sole risk.

10. Disclaimer of warranties

THE SERVICE AND ALL CONTENT AND DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE AVAILABLE, UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY CONTENT OR DATA IS ACCURATE, COMPLETE OR CURRENT.

Some jurisdictions do not permit the exclusion of certain warranties; in those jurisdictions the foregoing applies to the fullest extent permitted by law.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER TAGGED GU LLC NOR ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS OR LICENSORS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, OPPORTUNITY, GOODWILL, DATA OR COLLECTIBLE VALUE, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, AND (B) ONE HUNDRED US DOLLARS ($100).

These limitations apply to the fullest extent permitted by law and survive any failure of essential purpose of any limited remedy.

12. Indemnification

You agree to indemnify, defend and hold harmless Tagged GU LLC and its members, managers, officers, employees, contractors and agents from and against any claim, demand, proceeding, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or relating to your use of the Service, your breach of these Terms or of the Data and Commercial Use Policy, your violation of any law, or your infringement of the rights of any person. We will notify you of any such claim and may, at our option, assume its defence and settlement.

13. Suspension and termination

We may suspend, restrict or terminate your access to all or part of the Service at any time, with or without cause or notice. You may stop using the Service at any time and may request deletion of your account as described in the Privacy Policy. Provisions which by their nature should survive termination, including sections 3 and 5 to 16, shall survive.

14. Governing law and venue

These Terms, and any dispute arising out of or relating to them or to the Service, are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. You and we submit to the exclusive jurisdiction of the state and federal courts located in Indiana and waive any objection to venue in those courts. Nothing in this section limits our right to seek injunctive relief in any competent court.

15. Changes to these Terms

We may amend these Terms at any time by posting the amended version on the Service and updating the date above. Amendments take effect when posted unless stated otherwise. Your continued use of the Service thereafter constitutes acceptance. If you do not agree to an amendment, you must stop using the Service.

16. General

These Terms, together with the Privacy Policy and the Data and Commercial Use Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior understandings. If any provision is held unenforceable, it shall be modified to the minimum extent necessary or severed, and the remainder shall continue in effect. Our failure to enforce any provision is not a waiver of it. You may not assign or transfer these Terms; we may assign them freely, including in connection with any merger, acquisition or sale of assets. These Terms create no third-party beneficiary rights. We are not liable for any failure or delay arising from circumstances beyond our reasonable control. We may give notice to you by email or by posting on the Service.
