Data and Commercial Use Policy

This Data and Commercial Use Policy (this “Policy”) governs use of the data, records, classifications, compilations, analyses and other content made available through taggedgu.com and related services (together, “Tagged GU Data”). It is incorporated into, and forms part of, our Terms of Service. Capitalised terms not defined here have the meanings given in the Terms.
1. Ownership and sources
Tagged GU Data is compiled from publicly reported auction results, listings and related information published by auction houses and other third parties, together with our own classification, enrichment, organisation and analysis.
Underlying titles, descriptions, images and other source material remain the property of their respective owners. Our compilation, selection, arrangement, classification and presentation of that material, and any derived data, are our property or that of our licensors. Nothing in this Policy transfers ownership of anything to you.
2. Permitted use
Subject to the Terms and this Policy, you may access and use Tagged GU Data for your own lawful reference and research purposes, including research relating to your own collecting or trading activity. You may make limited, occasional reference to individual results in ordinary discussion, provided you attribute the source and, where practicable, link to the original listing.
3. Restrictions
Except as expressly permitted above, or under a separate written agreement with us, you shall not, and shall not permit or assist any person or system to:
- access Tagged GU Data by any automated or systematic means, including scraping, crawling, spidering, harvesting, mining, indexing, scripted access, browser automation or artificial intelligence agents;
- extract, download, copy, compile, archive or reconstruct Tagged GU Data in bulk or in any substantial part, whether at one time or cumulatively, and whether by automated means or manually;
- reproduce, publish, distribute, mirror, syndicate, display, license, sell, rent or otherwise make Tagged GU Data available to any third party, whether or not for charge;
- incorporate Tagged GU Data into any dataset, index, feed, database, publication, application, model, product or service;
- use Tagged GU Data to train, fine-tune, test, benchmark, evaluate or otherwise develop any model, algorithm or system;
- use Tagged GU Data to create, operate, support or improve any product or service that is competitive with or substantially similar to the Service;
- reverse engineer or attempt to derive our methodology, classification logic, scoring, data structures or non-public systems;
- circumvent or interfere with rate limits, access controls, authentication or other technical measures; or
- remove, obscure or alter any attribution, source reference or proprietary notice.
4. No licence implied; no bulk or programmatic access
We grant no licence, express or implied, to Tagged GU Data other than as expressly set out in the Terms and this Policy. No application programming interface, data feed, export facility or bulk access is offered, and none may be inferred from the availability of the Service or from any technical means by which it may be accessed.
5. Enforcement
We may monitor use of the Service for activity inconsistent with this Policy, and may apply such technical and operational measures as we consider appropriate, including rate limiting, verification measures, blocking of accounts, addresses or devices, suspension or termination of access, and any other remedy available to us at law or in equity. We may take such measures without notice.
6. Rights holders
If you are an auction house, photographer or other rights holder and consider that material on the Service should be removed or displayed differently, contact policy@taggedgu.com. It is our practice to act on such requests promptly and without requiring justification. We may also remove or restrict any material at any time at our discretion.
7. Permission and licensed access
Uses not permitted by this Policy may be available under a separate written agreement. Enquiries, including from researchers, journalists, auction houses and commercial partners, may be directed to policy@taggedgu.com. We are under no obligation to grant any request.
8. No warranty as to data
Tagged GU Data is provided “as is” and may be incomplete, inaccurate, out of date or mis-classified. We give no warranty as to its accuracy, completeness or fitness for any purpose, and accept no liability for reliance on it. The disclaimers and limitations of liability in the Terms apply to this Policy.
9. Changes
We may amend this Policy at any time by posting the amended version on the Service and updating the date above. Amendments take effect when posted unless stated otherwise.
